1. Scope, notice, and acceptance
These terms apply to Thomas KC IT computer, network, Wi-Fi, device, diagnostic, and software services (the “Services”). “Thomas KC IT,” “we,” and “us” mean Thomas KC IT, operated under EasyRelay Kansas City, and the people performing work for it. “Customer” and “you” mean the person requesting Services, delivering equipment, or authorizing work on a device or network.
Before Thomas KC IT begins work, the customer is provided or directed to these terms. After receiving that notice, a customer who asks us to perform services and voluntarily delivers a device, grants access to a network or system, or authorizes the agreed work accepts these terms for that job. If you do not agree, do not leave the equipment or authorize work.
A handwritten signature is not the only way agreement may be shown. The notice and voluntary conduct described above are intended to show acceptance.
Keep a copy. You may use your browser’s print or save function to retain these terms. The version made available for the job applies to that job.
4. Backups and the risk of data loss
Back up your data before service whenever it is possible to do so. Repair, reinstallation, part replacement, and even routine diagnosis can result in data loss, and hardware that is already failing can fail completely at any moment, including while we are working on it.
Thomas KC IT does not guarantee that data can be preserved, recovered, or restored unless data recovery is specifically the agreed Service, and even then a result cannot be guaranteed. A clean system rebuild or operating-system reinstallation removes the data and programs on that drive; we will tell you when the recommended fix involves that step, so you can decide first.
If you ask us to make a backup as part of the job, that backup covers the locations we agree on. It is not a promise that every file, setting, license, saved password, or program will transfer to a replacement device.
To the fullest extent permitted by law, Thomas KC IT is not responsible for lost data, lost licenses, or the cost of reconstructing data, except to the extent the loss was caused by our failure to use reasonable care.
5. Access, passwords, and remote sessions
Some work requires a sign-in, a device passcode, an administrator password, or network credentials. Provide only the access the agreed job actually needs. We use that access only to perform the Services you requested.
We do not want and do not ask for banking credentials, payment card details, or unrelated account passwords. Change any credential you shared once the work is finished. If a device has been compromised, plan on changing important passwords from a device you know is clean.
Remote support sessions happen only with your permission and only while you can see what is happening on the screen. You can end a remote session at any time.
We do not sell customer data. Information about a device or a job is used to perform the Services, communicate with you, and keep our own records. We may have to keep or disclose information where the law requires it.
6. Diagnosis, hidden conditions, and equipment condition
You authorize the reasonable inspection, testing, disassembly, component removal and reinstallation, scanning, and configuration changes needed for the agreed Services. Diagnosis is based on the symptoms and conditions that can be observed or reproduced while the device is with us.
Work may expose failing storage, corrosion, liquid damage, previous repair errors, worn connectors, brittle plastics, stripped screws, degraded batteries, incompatible components, pirated or unlicensed software, or malware. These conditions can change the time, parts, or approach required, and some of them make a device unsafe or uneconomical to repair.
Thomas KC IT is not responsible for a pre-existing or hidden condition merely because it becomes visible or fails during reasonable diagnosis, disassembly, or testing. This does not excuse damage caused or increased by our failure to use reasonable care.
Intermittent faults may not appear while the device is with us. We will say so plainly rather than replace parts at random hoping the symptom disappears.
7. Pricing, parts, payment, and pickup
There is no single price that fits every computer or network problem. We first learn enough to understand the issue, then explain the likely fix and the expected cost before the repair or setup work begins. If diagnosis uncovers something materially different, we stop and discuss the new information with you before continuing.
You are responsible for charges for the requested and authorized Services actually performed and the parts, software, or materials actually used or specially obtained for that work. Payment is due when the work is complete and before pickup unless we agree otherwise. Any deposit, diagnostic fee, cancellation term, special-order restriction, or storage charge applies only if it is separately disclosed and agreed before that work.
Please pick up equipment promptly after notice that the work is complete. We may exercise only those collection, possession, lien, storage, or unclaimed-property remedies available under applicable law, and only after any separate notice, written authorization, or other legal requirement has been satisfied. These online terms do not replace a document that applicable law requires for a particular remedy.
8. Parts, customer-supplied equipment, and licensing
Parts availability, compatibility, and prior work can affect a job. We may refuse a customer-supplied part or device that appears unsafe, counterfeit, damaged, incompatible, or unsuitable for the requested use.
Unless we expressly agree otherwise in writing, Thomas KC IT does not warrant the design, quality, compatibility, or durability of customer-supplied parts, and you remain responsible for additional labor reasonably required because a supplied part does not fit, is defective, or creates additional work. This does not limit responsibility for our own installation workmanship.
You are responsible for holding valid licenses for the operating systems and software you ask us to install, reinstall, or transfer, and for any subscription needed to keep them working. We will not install software you are not licensed to use, and we cannot transfer a license that its publisher does not allow to be transferred.
Replaced parts may be returned to you if you ask before work begins. Return may not be possible for warranty exchanges, hazardous items such as swollen batteries, or items that law or supplier terms require us to retain or dispose of. Storage media may be wiped before disposal to protect your data.
9. Service results, whole-device condition, and follow-up
Service on one complaint, component, or system is not a complete inspection of the entire device, network, or environment unless that inspection is specifically requested and accepted as the agreed Service. A successful repair does not guarantee that an unrelated component will not fail later, and an older device that has been repaired is still an older device.
Malware removal, cleanup, and security work reduce risk; they cannot guarantee that a system is or will remain free of every threat, and they cannot undo a compromise that already exposed an account or a password. Network and Wi-Fi performance depends on the building, the equipment, the connected devices, and the service delivered by your internet provider, so we do not promise a particular speed, range, or uptime.
Contact us promptly if the original symptom returns after pickup, and give us a reasonable opportunity to look at a claimed workmanship issue when that is practical. This paragraph does not reduce any mandatory legal right.
10. Warranties and responsibility
Any express service or parts warranty must be stated on the invoice or in a separate written warranty. Manufacturer warranties, if any, are provided by the manufacturer under its own terms, and some repairs or modifications can affect a manufacturer warranty. To the fullest extent permitted by law, Thomas KC IT disclaims other implied warranties that may lawfully be disclaimed.
To the fullest extent permitted by law, Thomas KC IT is not liable for indirect, special, incidental, exemplary, or consequential economic losses such as lost profits, lost business, missed deadlines, loss of use, substitute equipment, or downtime arising from the Services. This exclusion does not apply where applicable law does not permit it.
Nothing in these terms excuses Thomas KC IT from responsibility for direct loss caused by our failure to use reasonable care, or excludes or limits liability that applicable law does not allow to be excluded or limited, including liability arising from gross negligence, willful misconduct, fraud, or mandatory consumer-protection law.
11. Onsite visits and lawful use
For work at a home or office, you are responsible for providing safe access to the equipment and the areas the job requires, and for authorizing any change to a network you do not own or control. Tell us in advance about equipment leased from a provider, landlord restrictions, or wiring we should not disturb.
You are responsible for determining whether a requested configuration is lawful and permitted where it will be used, including monitoring or filtering intended for other people’s devices. We will not knowingly perform work that appears unlawful, and we may decline work that we believe is unsafe or that we cannot perform properly.
12. Mandatory rights and general terms
These terms do not waive a right or remedy that applicable law does not permit you to waive. If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver.
These terms apply to Thomas KC IT computer, network, Wi-Fi, device, and software services only.
These terms, together with the specific service request or authorization, the invoice, and any express written warranty, are the agreement concerning the subjects they address. A specific written term for a particular job controls over a conflicting general statement on this page. Changes apply only to future jobs unless both sides agree otherwise.
