1. Acceptance of these terms
These terms apply to each purchase and use of a Crashout Performance digital motorcycle dashboard and its accessories (the “Product”). “Seller” means Crashout Performance and its owners, members, employees, contractors, and agents.
By purchasing, accepting delivery of, installing, or using the Product, you confirm that you are at least 18 years old, have read these terms, understand the warnings, and agree to be bound by the version presented to you at the time of purchase.
2. Off-road and closed-course use only
The Product is intended only for off-road, closed-course, competition, exhibition, or testing use. It is not represented or certified as compliant with federal, state, or local requirements for operation on public roads.
You are solely responsible for determining whether possession, installation, and use are lawful where the motorcycle is operated. Do not use the Product in any way that violates traffic, vehicle-equipment, emissions, racing, or safety laws.
3. Safety and installation responsibilities
- Installation should be performed or inspected by a qualified motorcycle technician.
- Disconnect power and follow appropriate electrical and workshop safety procedures during installation.
- Do not allow the Product, mount, or wiring to interfere with steering, braking, throttle operation, controls, visibility, or other safety equipment.
- Confirm that all fasteners, wiring, and connectors are secure before every use.
- Stop using the Product immediately if it becomes loose, damaged, unreadable, unreliable, overheated, or otherwise abnormal.
- Never configure, view, or interact with nonessential display functions while the motorcycle is moving.
The Product supplements information available to the rider; it does not replace safe riding practices, required factory equipment, warning indicators, maintenance, inspection, or the rider’s independent judgment.
4. Assumption of risk
Motorcycling, racing, vehicle modification, electrical work, and off-road or closed-course operation are inherently dangerous and can result in loss of control, collision, fire, electrical failure, property damage, serious injury, paralysis, or death.
To the fullest extent permitted by law, you knowingly and voluntarily assume the risks arising from installation, testing, possession, and use of the Product, including risks caused by improper installation, incompatible equipment, misuse, racing conditions, environmental exposure, distraction, inaccurate inputs, component failure, or failure to maintain or inspect the motorcycle.
5. Warranty disclaimer
To the fullest extent permitted by applicable law, the Product is provided “as is” and “with all faults.” Seller disclaims all implied warranties, including merchantability and fitness for a particular purpose, and any warranty arising from course of dealing or usage of trade.
Some jurisdictions do not permit some warranty exclusions. In those jurisdictions, this section applies only to the maximum extent permitted by law. Nothing in this section excludes an express written warranty, if any, that applicable law treats as part of the sale.
6. Limitation of liability
To the fullest extent permitted by law, Seller will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, use, or racing time; substitute-equipment costs; vehicle or other property damage; or personal injury or death arising from or related to the Product, its installation, or its use, including claims based on ordinary negligence.
To the fullest extent permitted by law, Seller’s total aggregate liability for any claim relating to the Product will not exceed the amount actually paid to Seller for the specific Product giving rise to the claim.
Nothing in these terms excludes or limits liability that applicable law does not allow to be excluded or limited, including liability that may arise from gross negligence, willful misconduct, fraud, or mandatory product-liability and consumer-protection law.
7. Misuse and third-party claims
To the fullest extent permitted by law, you agree to defend, indemnify, and hold Seller harmless from third-party claims, losses, fines, penalties, and reasonable costs arising from your unlawful use, racing activity, resale, modification, improper installation, failure to follow these warnings, or use of the Product on a public road.
8. Compatibility and custom content
Compatibility depends on the exact motorcycle year, make, model, wiring, equipment, and condition. You are responsible for providing accurate configuration information and for confirming the delivered Product is suitable before operation.
You represent that you have the rights and permissions necessary for every logo, image, name, or other content supplied for a custom design or splash screen. You authorize Seller to reproduce that content only as needed to fulfill and support your order.
Motorcycle manufacturer names identify compatibility only. Crashout Performance and EasyRelay are not affiliated with, sponsored by, or endorsed by those manufacturers.
9. General terms
If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver. These terms and any separate written order terms are the entire agreement concerning the subjects addressed here.
