1. Scope, notice, and acceptance
These terms apply to Crashout Performance motorcycle services (the “Services”) and Crashout Performance digital motorcycle dashboards, accessories, and related custom items (the “Products”). “Crashout,” “we,” and “us” mean Crashout Performance, operated under EasyRelay Kansas City, and the people performing work for it. “Customer” and “you” mean the person requesting Services, delivering a motorcycle, or purchasing, accepting, installing, or using a Product.
Before Crashout accepts a motorcycle, the customer is provided or directed to these terms. After receiving that notice, a customer who asks Crashout to perform services and voluntarily delivers, leaves, or arranges delivery of the motorcycle for the agreed services accepts these terms for that service visit. If you do not agree, do not leave the motorcycle or authorize work.
A handwritten signature is not the only way agreement may be shown. The notice and voluntary conduct described above are intended to show acceptance. For a Product, you accept these terms by placing an order, accepting delivery, installing, or using it after these terms are presented or made available.
Keep a copy. You may use your browser’s print or save function to retain these terms. The version made available for the service visit or order applies to that transaction.
4. Inspection, diagnosis, disassembly, and hidden conditions
You authorize the reasonable inspection, diagnostic checks, access, removal and reinstallation of components, disassembly, scanning, electrical testing, and other steps needed for the agreed Services. Diagnosis is based on the symptoms and conditions that can be observed or reproduced while the motorcycle is with us.
Work may expose corrosion, stripped or seized fasteners, brittle connectors, damaged wiring, incompatible components, prior repair errors, concealed damage, contamination, internal wear, or other pre-existing or hidden conditions. These conditions can change the time, parts, or approach required.
Crashout is not responsible for a pre-existing or hidden condition merely because it becomes visible or fails during reasonable access or testing. This does not excuse damage caused or increased by our failure to use reasonable care.
5. Custody, handling, starting, and testing
Within the agreed scope, you authorize our personnel to receive, store, push, move, secure, lift, support, energize or de-energize, connect diagnostic or charging equipment to, start, run, scan, and stationary-test the motorcycle when reasonably needed.
A test ride on a public road is not automatically authorized by drop-off. It requires specific customer permission and will occur only if Crashout decides it is reasonably necessary, safe, insured, and lawful. Tell us before leaving the motorcycle if it is not registered, insured, roadworthy, or legally permitted on public roads.
Motorcycles, modified vehicles, electrical systems, fuel systems, and moving or heated components involve inherent risks. You assume the ordinary risks inherent in the motorcycle’s existing condition and in the modifications you requested, but not loss caused by Crashout’s failure to use reasonable care.
6. Pricing, parts, payment, and pickup
Labor time and required parts are not always known before a motorcycle is inspected, opened, diagnosed, or worked through. Crashout therefore does not promise a firm advance price for every service job. Final pricing is provided after the work is complete and is based on the labor time, parts, and materials the job actually required.
This pricing method does not authorize unrelated work, a materially different project, or unlimited charges. A spending limit or maximum charge applies only if Crashout accepts it in a written or electronic message before the relevant work.
You are responsible for charges for the requested and authorized Services actually performed and the parts or materials actually used or specially obtained for that work. Payment is due when the work is complete and before pickup unless we agree otherwise. Any deposit, cancellation term, special-order restriction, or storage charge applies only if separately disclosed and agreed.
Please pick up the motorcycle promptly after notice that work is complete. We may exercise only those collection, possession, lien, storage, or unclaimed-property remedies available under applicable law and only after any separate notice, written authorization, maximum-charge statement, storage-rate disclosure, or other legal requirement has been satisfied. These online terms do not replace a document that applicable law requires for a particular remedy.
7. Parts, customer-supplied components, and prior work
Parts availability, fitment, quality, and prior modifications can affect a job. We may refuse a customer-supplied or previously installed part that appears unsafe, incompatible, counterfeit, damaged, incomplete, or unsuitable for the requested use.
Unless we expressly agree otherwise in writing, Crashout does not warrant the design, quality, fitment, durability, legality, or manufacturer claims of customer-supplied parts. Subject to the agreed scope and any additional authorization required under Section 3, you remain responsible for additional labor or materials reasonably required because a supplied part does not fit, is defective, lacks hardware or instructions, or creates additional work. This does not limit responsibility for our own installation workmanship.
If you want replaced parts returned, ask before work begins. Return may not be possible for warranty cores, exchange parts, hazardous materials, damaged consumables, or items that law or supplier terms require us to retain or dispose of.
8. Service results, whole-bike condition, and follow-up
Service on one complaint, component, or system is not a complete safety inspection of the entire motorcycle unless that inspection is specifically requested and accepted as the agreed Service. Even a complete inspection is not a certification or guarantee that every condition or future failure will be discovered. Restoration work occurs only when it is specifically included in the agreed scope. A successful repair does not guarantee that an unrelated component will not fail later.
Intermittent faults may not occur while the motorcycle is with us. Performance results vary with the motorcycle, existing condition, installed parts, environment, fuel, setup, rider, and intended use. We do not promise a particular horsepower figure, lap time, speed, reliability result, or legal classification unless stated in a separate written agreement.
After pickup, follow any service, break-in, inspection, or operating instructions we provide. Stop operating the motorcycle and contact us promptly if the original symptom returns or you notice a leak, warning, unusual sound, loose part, electrical issue, control problem, overheating, or other unsafe condition. Give us a reasonable opportunity to inspect a claimed workmanship issue when practical. This paragraph does not reduce any mandatory legal right.
9. Service warranties and responsibility
Any express service or parts warranty must be stated on the invoice or in a separate written warranty. Manufacturer warranties, if any, are provided by the manufacturer under its own terms. To the fullest extent permitted by law, Crashout disclaims other implied warranties that may lawfully be disclaimed.
To the fullest extent permitted by law, Crashout is not liable for indirect, special, incidental, exemplary, or consequential economic losses such as lost profits, missed events, racing fees, loss of use, substitute transportation, or downtime arising from Services. This exclusion does not apply where applicable law does not permit it.
Nothing in these terms excuses Crashout from responsibility for direct loss caused by our failure to use reasonable care, or excludes or limits liability that applicable law does not allow to be excluded or limited, including liability arising from gross negligence, willful misconduct, fraud, or mandatory consumer-protection law.
10. Performance work and lawful use
You are responsible for determining whether requested performance, emissions, lighting, electrical, fabrication, or other modifications are lawful for the motorcycle’s registration, location, intended use, racing organization, and operation. Crashout will not knowingly perform prohibited work and may decline work that we believe is unsafe or unlawful.
Parts sold or work performed for off-road, closed-course, competition, exhibition, or testing use must not be used on public roads when prohibited. Crashout does not promise that a modified motorcycle will pass an inspection, remain covered by a manufacturer warranty, or comply with every emissions, equipment, insurance, racing, or traffic requirement.
11. Product orders, pricing, compatibility, and custom content
The Product price and included configuration will be shown in the checkout, invoice, or written order details. A base or estimated price does not include an option, custom request, tax, shipping charge, installation service, or other item unless it is listed. We will not substitute a materially different configuration or add an undisclosed charge without customer approval.
Any deposit, balance-due schedule, production estimate, delivery arrangement, cancellation term, return or refund policy, or restriction for a personalized item applies only if it is disclosed for the order before purchase and accepted by the customer, or if applicable law requires it. Parts availability, correct customer information, and custom design approval can affect production timing. An estimated completion or delivery date is not a guarantee unless we expressly make it one in writing.
Compatibility depends on the exact motorcycle year, make, model, wiring, equipment, modifications, and condition. You are responsible for providing accurate configuration information and confirming the delivered Product is suitable before operation.
You represent that you have the rights and permissions necessary for every logo, image, name, or other content supplied for a custom design or splash screen. You authorize Crashout to reproduce that content only as needed to fulfill and support your order.
Motorcycle manufacturer names identify compatibility only. Crashout Performance and EasyRelay Kansas City are not affiliated with, sponsored by, or endorsed by those manufacturers.
12. Off-road and closed-course use only
The Product is intended only for off-road, closed-course, competition, exhibition, or testing use. It is not represented or certified as compliant with federal, state, or local requirements for operation on public roads.
You are responsible for determining whether possession, installation, and use are lawful where the motorcycle is operated. Do not use the Product in a way that violates traffic, vehicle-equipment, emissions, racing, or safety laws.
13. Product safety and installation responsibilities
- Installation should be performed or inspected by a qualified motorcycle technician.
- Disconnect power and follow appropriate electrical and workshop safety procedures during installation.
- Do not allow the Product, mount, or wiring to interfere with steering, braking, throttle operation, controls, visibility, or other safety equipment.
- Confirm that all fasteners, wiring, and connectors are secure before every use.
- Stop using the Product immediately if it becomes loose, damaged, unreadable, unreliable, overheated, or otherwise abnormal.
- Never configure, view, or interact with nonessential display functions while the motorcycle is moving.
The Product supplements information available to the rider; it does not replace safe riding practices, required factory equipment, warning indicators, maintenance, inspection, or the rider’s independent judgment.
14. Product risk and warranty disclaimer
Motorcycling, racing, vehicle modification, electrical work, and off-road or closed-course operation are inherently dangerous and can result in loss of control, collision, fire, electrical failure, property damage, serious injury, paralysis, or death.
You knowingly assume the inherent and disclosed risks arising from installation, testing, possession, and use of the Product, including risks caused by improper installation, incompatible equipment, misuse, racing conditions, environmental exposure, distraction, inaccurate inputs, component failure, or failure to maintain or inspect the motorcycle. You do not assume a risk that applicable law places on Crashout because of our own misconduct or failure to use reasonable care.
To the fullest extent permitted by applicable law, the Product is provided “as is” and “with all faults.” Crashout disclaims all implied warranties that may lawfully be disclaimed, including merchantability and fitness for a particular purpose, and any warranty arising from course of dealing or usage of trade.
Some jurisdictions do not permit some warranty exclusions. In those jurisdictions, this section applies only to the maximum extent permitted by law. Nothing in this section excludes an express written warranty, if any, that applicable law treats as part of the sale.
15. Product liability boundaries and third-party claims
To the fullest extent permitted by law, Crashout will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, data, use, or racing time; or substitute-equipment costs arising from the Product, its installation, or its use.
For a Product claim that does not involve personal injury, damage caused by our failure to use reasonable care, gross negligence, willful misconduct, fraud, or a right that cannot lawfully be limited, Crashout’s total aggregate liability will not exceed the amount actually paid to Crashout for the specific Product giving rise to the claim.
To the fullest extent permitted by law, you agree to defend, indemnify, and hold Crashout harmless from third-party claims, fines, penalties, and reasonable costs arising from your unlawful use, racing activity, resale, unauthorized modification, improper installation by someone other than Crashout, failure to follow these warnings, or prohibited use of the Product on a public road. This obligation does not apply to the extent a claim was caused by Crashout’s negligence, gross negligence, willful misconduct, fraud, or other conduct for which indemnity is not permitted.
16. Mandatory rights and general terms
These terms do not waive a right or remedy that applicable law does not permit you to waive. If a provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. A failure to enforce a provision is not a waiver.
These terms, together with the specific service request or authorization, invoice, Product order, and any express written warranty, are the agreement concerning the subjects they address. A specific written term for a particular job or order controls over a conflicting general statement on this page. Changes apply only to future visits or orders unless both sides agree otherwise.
